Sharon asks…

My motorcycle was stolen. I want to sell the frame. Do I have to turn in my title in and get a salvage title?

I have the title in hand. How do I get the frame sold right with no issues to the buyer. I hear you have to turn in the title and replace it with a salvage title. How true is that? Can I just sell the frame and claim a clean title?
I had no full coverage ins. on the bike

If you got the motorcycle back in such bad condition that the insurance company wrote it off as "totaled" The insurance company will have filed paperwork with the state that lists the VIN as a salvage vehicle.. Essentially you "bought back" the remains from the insurance company (or they gave you the ple of junk) after paying off the claim.

So... You do have to get the salvage title. (if insurance was involved)

If there was no insurance involved... It won't have been listed with the state as being a write-off... And... If someone wants to buy the frame and repair the vehicle... Its just a VERY major repair.

The law is a bit wierd about "salvage" vehicles. If it hasn't gone to a salvage yard... You are not necessarilly required to get a salvage title (unless the insurance company files it as being salvage)

This "quirk" in the law is how you could buy an essentially trashed VW bug (1960's/70's style...) LICENCE IT... Haul the "pan" to Mexico (junk the body, engine, transmission, and all the rest... Except the "pan" and the VIN plate) and have a NEW beetle put on the pan. (they were making the same car in Mexico until just a couple of years ago... Not sure you can still do it) Then drive the vehicle back to the US..... When its not legal to import one of the Mexican Bugs that was never in the US before...

There are a bunch of 196X/200X and 197X/200X "rebuilt" VW bugs in the US.... I used to know one of the dealers for a company that did that on a large scale.

Betty asks…

I purchased a used motorcycle?

I purchased a motorcycle and can not get it registered or titled because the car dealership has a nonrepairable certification from DMV stating that the dealership can not get the title in their name. The dealership stated that I still owe them money on the bike and I do not want to pay because I'm stuck with this bike and not can't ride it. I love this bike and was told that I could purchase a new frame and get a clean title, however can the dealership repo the bike from me since i owe them money. They are not the lein holders and was not suppose to sell it to me but I don't want to get in trouble. What should I do. Oh and I have a bill of sell saying i owe them zero dollars and I have to Maryland Salvage Title to.
The motorcycle was not sold for parts. He sold it to me for $2,300.00 I only paid $1,100.00 and now he keeps calling because I owe him more money and saying he is going to report it stolen. DMV denied him ownership because when they have on record that the motorcycle had way to many damages. Therefore it is unrepairable and can only be sold as parts. The car spot in in richmond, va and he wont give me any money back so legally what the hell should i do. I was told that you could go on line and purchase frams and get someone to put it on

Ah.... The bike was sold to you for $2,300, you paid $1,100. You still owe $1,200. Looks like grand theft auto to me.
