I reside near Chicago and can help with delivery. I also have a complete 1978 or 1979 XS 650 Yamaha. Bike is titled in my name and is free and clear. Again I can help with delivery. - Just sold a clean titled Motorcycle that looks like it has had previous body (frame) work.?
I bought a motorcycle from a previous owner (private sale) in TX. The title is a clear title. I had the bike for about 8 months then sold it to someone else (private sale). He has had it for about a month. He just got a 4000 mile inspection on it. He took it to a dealership and when they were inspecting it, they found that the frame had been damaged and welded back together then spraypainted black. It looked like a cover up. That person I sold it to now wants to take me to court and have me take back the motorcyle and give him back his money. I had no clue this was an issue at all. I never took it anywhere to get work done on it, never even had the oil changed as I had only had it for about 400 miles. I need to know what I need to do to protect myself, if I can actually be in trouble and if I do return the funds and take back the bike, if I could then go after the previous seller. Any help would be much appreciated as I have no idea what I am in for. I dont think its just as simple as selling it 'as is' cause it looks like that kind of frame damage would salvage the vehicle, its just not on any sort of report anywhere or on the title.
A The truth is he hasn't got a leg to stand on.You bought the bike in good faith and sold it the same way. There's no report on the title as it being a salvage bike and you have no way of knowing unless you did it.Both you and the new owner made the same mistake you should have had prepurchase inspection done before you bought the bike.
